How we handle personal data on this website and in Nayitapubmark's WhatsApp assistant.

1. Data controller

Nayita Publicidad y Marketing, with registered address at Galerias Obarrio, Panama City, Panama, is the controller of the personal data collected through this website (nayitapubmark.com) and through our artificial intelligence agent on WhatsApp. For anything related to this policy, write to info@nayitapubmark.com.

2. Legal basis

We process your data under Law 81 of 26 March 2019 on personal data protection of the Republic of Panama and its regulations. The lawful basis is your consent — given by continuing to browse, accepting analytics cookies or starting a conversation with us — and, where a commercial relationship already exists, performance of the services agreement.

3. Data we collect on this website

When you visit nayitapubmark.com the following data is processed, most of it automatically:

  • Browsing data: IP address, device and browser type, pages visited, time on page and referring site. Collected by Google Analytics 4 through cookies and used in aggregate to understand which content is useful.
  • Contact events: we record anonymously when someone taps the WhatsApp, call or email link, so we know which pages generate enquiries. It is not tied to an identified person.
  • Chat conversations: if you write to the assistant at the bottom right, your message and any details you provide are processed to handle your enquiry.
  • Server logs: our hosting provider keeps technical access logs, including IP address, for security and diagnostics.

4. Cookies

This site uses no advertising or profiling cookies. We use two categories:

  • Necessary cookies: remember basic preferences such as your chosen language. Without them the site does not work properly.
  • Analytics cookies (Google Analytics 4): measure visits and browsing behaviour in aggregate. You can refuse or delete them from your browser settings, or install Google's opt-out add-on, without affecting your use of the site.

You can clear cookies already stored at any time from your browser's privacy settings.

5. Data we collect in the WhatsApp assistant

Through our assistant we may request and process:

  • First and last name.
  • Phone number (WhatsApp ID).
  • Health information voluntarily provided in order to book appointments.
  • Audio and text messages sent for transcription and AI analysis.

6. Purpose of processing

The data will be used exclusively to:

  • Answer the enquiries you send through the site, the chat or WhatsApp.
  • Manage and schedule appointments in our calendar, and send reminders.
  • Understand in aggregate how the site is used in order to improve its content.
  • Deliver and invoice contracted services, where a commercial relationship exists.

We make no automated decisions with legal effects on you, and we build no profiles for advertising purposes.

7. Providers and transfers

To deliver the service we rely on technology providers that may process data outside Panama, subject to their own privacy policies and to contractual confidentiality commitments:

  • Google LLC: site analytics (Google Analytics 4) and artificial intelligence processing (Gemini API).
  • Meta Platforms, Inc.: WhatsApp messaging platform.
  • Hostinger International: site hosting and technical access logs.
  • NahIA (nahia.ai), a brand of this same company: chat assistant embedded in the site.
  • n8n: workflow automation engine behind the assistant.

We do not sell or share your data with third parties for commercial purposes.

8. Retention

We keep contact and conversation data for as long as our relationship with you lasts and, afterwards, for the period needed to meet legal or contractual obligations. Analytics data is kept in aggregate according to Google Analytics retention settings. You may request deletion before those periods.

9. Security

We implement technical and organisational measures to protect the information: encryption in transit (HTTPS) across the site, restricted access to the accounts that handle data, and providers with recognised standards. Users are reminded that WhatsApp communications depend on Meta's infrastructure.

10. Your rights (ARCO)

You have the right to access, rectify, cancel or object to the use of your data, and to withdraw your consent at any time. Write to info@nayitapubmark.com and we will respond within the periods set by Law 81. For the WhatsApp assistant history, sending a message with the word “ELIMINAR” is enough.

11. Consent and changes

By browsing this site or interacting with our assistant, you accept the terms of this policy. If we amend it, we will publish the new version at this same address with its update date.
