Terms of service
Conditions of use for nayitapubmark.com and the general framework for the agency's services.

1. Who we are
This site belongs to Nayita Publicidad y Marketing, a digital marketing agency specialised in healthcare, with address at Galerias Obarrio, Panama City. You can reach us at info@nayitapubmark.com or on WhatsApp at +507 6627-3753.
2. Use of the site
You may read, quote and share the content of this site freely, citing the source. You may not copy it wholesale to republish as your own, nor use the site in ways that affect its operation or attempt to reach non-public areas.
3. Content is informational
The guides, articles and figures we publish are informational and reflect our experience managing healthcare accounts in Panama. They are not legal, medical or financial advice, and they guarantee no specific outcome: every practice, specialty and market behaves differently.
For medical advertising, responsibility for complying with current regulation and professional codes of ethics always rests with the advertising professional or facility.
4. Prices and quotes
Prices published on the site are “from” references in US dollars, meant to indicate the order of magnitude of each service. They are not a binding offer: the final price is set in a written quote after the diagnosis, and that quote governs the relationship.
- Advertising spend (Google Ads, Meta Ads) is paid directly to the platform and is separate from our management fees.
- Unless stated otherwise, prices exclude applicable taxes and third-party services such as domains, hosting or licences.
5. Engagement and delivery
Services are engaged through a written proposal accepted by both parties, setting out scope, timelines, deliverables and payment terms. The timelines we quote start when we receive the materials we need (copy, photographs, access): delays in providing them move the publication date.
6. Ownership of accounts and material
This is an agency principle, not a negotiable exception: the domain, hosting, ad accounts, Google Business Profile and social profiles always stay in the client's name, and we work as invited users. When the relationship ends, the client keeps their access and their history.
- Delivered and approved material (website, graphics, photography and video) becomes the client's once the project is paid in full.
- We keep the right to show the work in our portfolio, unless agreed otherwise in writing.
- Third-party licences (fonts, plugins, stock imagery) are governed by their own terms.
7. Liability
We are liable for the proper delivery of the contracted services. We are not liable for interruptions or rule changes on third-party platforms (Google, Meta, WhatsApp, hosting providers), for content the client publishes independently, or for commercial results that depend on factors outside our control, such as patient handling or appointment capacity.
8. External links
The site may link to third-party pages for further information. We do not control their content or privacy policies, and their inclusion does not imply endorsement.
9. Privacy
The processing of personal data is governed by our Privacy policy, which forms part of these terms and details what data we collect on the site and in the WhatsApp assistant.
10. Governing law and changes
These terms are governed by the laws of the Republic of Panama, and any dispute will be submitted to its competent courts. We may update them by publishing a new version at this address with its date; continued use of the site implies acceptance.
